New Regulations for Second-Hand Car Dealerships in Chengdu Shuangliu District

Recently, our reporter learned from the Chengdu Shuangliu District Market Supervision and Administration Bureau that the bureau, jointly with the District Commerce Bureau, the Shuangliu Branch of the Municipal Public Security Bureau, and the District Urban Management and Comprehensive Administrative Law Enforcement Bureau, has released the Guidance List for Commercial Advertising Information in Second-Hand Car Dealership (Brokerage) (hereinafter referred to as the "Guidance List") and the Negative List for Assessment Practices in Second-Hand Car Dealership (Brokerage) (hereinafter referred to as the "Negative List").

According to reports, the newly released Guidance List is designed to regulate the 15 items of information that operators must disclose to consumers before signing a transaction contract or collecting a deposit. The Guidance List requires that operators proactively, truthfully, and comprehensively disclose vehicle information to consumers, and must not conceal, mislead, or omit any details. The specific information to be disclosed covers multiple aspects, including basic vehicle information, technical condition, warranty and after-sales service, and pricing. For example, operators must clearly disclose the vehicle's brand and model, registration and transfer history and any rights restrictions, usage nature, whether the vehicle has been in an accident, flood, or fire, the repair status of core components, odometer verification status, warranty commitments, and the vehicle price along with itemized fees. If financing is recommended, details such as interest rates, repayment periods, total interest, and handling fees must also be disclosed. Operators are also required to give truthful and clear answers to consumers' relevant questions.

The Negative List, on the other hand, enumerates 21 prohibited activities in second-hand car operations across multiple dimensions, including qualification assessment, vehicle transaction management, consumer rights protection, advertising and competition, pricing management, and urban management. These prohibitions include: operating without a license; issuing false appraisal reports; trading vehicles that are explicitly prohibited by the state, with a requirement to promptly report any vehicles suspected of illegal involvement; including unfair standard clauses in contracts; concealing critical vehicle conditions such as accident history, flood damage, or odometer tampering; fraudulently inducing consumers to sign contracts; forcing services upon consumers; and selling consumers' personal information. In terms of advertising, the Negative List prohibits false advertising, the use of absolute language, false commercial promotions, and actions that harm business reputations. For pricing, clear price marking is required, and price fraud as well as unjustified price discrimination are prohibited. Additionally, the list strictly forbids the unauthorized occupation of public roads for parking vehicles for sale, using public roads for promotional activities, and illegally installing outdoor advertisements that affect city appearance and traffic.
